Blueberry provides law school application tracking tools, school data analytics, and related services to help prospective law students manage their application process.

By creating an account, accessing, or using the Service, you confirm that:

• You are at least 18 years of age or have reached the age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• You will comply with these Terms and all applicable laws and regulations.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Service thereafter.

Continuing to use the Service following the posting of revised Terms of Service means that you accept and agree to the changes. You are expected to check this page each time you access the Service so you are aware of any changes, as they are binding on you.

For material changes, we will make reasonable efforts to notify you via email or through a notice on our website.

As a user of the Service, you agree to:

• Provide accurate, current, and complete information during registration and keep your account information updated.
• Maintain the security and confidentiality of your account credentials and not share your login information with others.
• Notify us immediately of any unauthorized access or use of your account.
• Use the Service only for lawful purposes and in accordance with these Terms.

To access certain features of the Service, you must create an account. When you create an account:

• You are responsible for maintaining the confidentiality of your password.
• You agree to accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms or engaged in any fraudulent, abusive, or unlawful activity.

Blueberry is a paid subscription service. By starting a subscription or free trial, you authorize Blueberry to charge applicable fees using your selected payment method.

If a free trial is offered, it is provided for a limited time. Unless canceled before the trial period ends, your subscription will automatically convert to a paid subscription and your payment method will be charged.

Subscriptions renew automatically unless canceled prior to the renewal date. You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period.

Blueberry offers a 14-day refund window from the date of your initial paid subscription charge. Refund requests must be submitted within this period. After 14 days, all fees are non-refundable, except where required by law. Refunds apply only to the initial subscription charge and do not apply to renewal payments, partial billing periods, or unused time.

The Service and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, graphics, and design) are owned by Blueberry Analytics LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service without our prior written consent.

You retain ownership of any content you submit, post, or display on or through the Service (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of operating and providing the Service.

You represent and warrant that:

• You own or have the necessary rights to your User Content.
• Your User Content does not violate any third-party rights or applicable laws.
• Your User Content is accurate and not misleading.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable.

You agree not to use the Service:

• In any way that violates any applicable federal, state, local, or international law or regulation.
• To transmit any advertising or promotional material without our prior written consent.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.

• To introduce any viruses, malware, or other harmful material.
• To attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems.
• To use any automated means to access the Service or collect data without our permission.
• To scrape, harvest, or collect information about other users.

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Blueberry Analytics LLC. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by or in connection with the use of any such content, goods, or services available through any such websites or services.

The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, Blueberry Analytics LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not guarantee the accuracy, completeness, or usefulness of any information provided through the Service.

The data and analytics provided through the Service are for informational purposes only and should not be considered as legal, academic, or professional advice. Admission decisions are made solely by law schools, and we make no guarantees regarding admission outcomes.

To the maximum extent permitted by applicable law, in no event shall Blueberry Analytics LLC, its affiliates, officers, directors, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Any content obtained from the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless Blueberry Analytics LLC, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Service.Toggle Content

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to the personal jurisdiction and venue of such courts.

Any dispute arising from these Terms or the Service shall first be attempted to be resolved through informal negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion feature within the Service.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity and enforceability of the remaining provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blueberry Analytics LLC regarding your use of the Service and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
